Terms of Use

You must be at least 14 years of age (or the age of legal majority in your jurisdiction, whichever is higher) to create an account on the Platform. Where local law requires parental authorisation for minors, you represent that such authorisation has been obtained.

TURÓ reserves the right to refuse access to users under the legal age, in its sole discretion.

Any persons who are "incompetent to contract" including but not limited to minors, un-discharged insolvents, etc., are not eligible to use, access, or transact on the Platform.

You are responsible for maintaining the confidentiality of your User Account credentials and for all activities that occur under your account. You agree to: create a strong and secure password; not share your credentials with any third party; immediately notify us of any unauthorised use of your account or other breach of security; and ensure you log out at the end of each session on shared devices.

To use the Services, you must create a User Account by providing your name, contact number, email address, a one-time password, and any other required information. You may also sign up or log in via a third-party network such as Apple, based on that provider's privacy policy.

Upon account creation you will be required to provide: date of birth; gender; fitness goals (e.g., weight loss, muscle gain, sustenance); height and weight; body fat percentage; habits and workout preferences; dietary preferences; activity level; and health conditions or restrictions.

You may optionally add further details such as previous workout history and device health data. Certain information may constitute health data under applicable law and will only be processed in accordance with our Privacy Policy and, where required, your explicit consent.

The User is solely responsible for the accuracy of the information provided. Inaccurate information may affect the quality of recommendations offered. TURÓ reserves the right to suspend or terminate accounts where information is found to be untrue, inaccurate, or incomplete. You agree to create only one User Account for personal use and not to share it with others.

Activity Tracking: The Platform enables you to record and track physical activities using geolocation, device sensors, manual input, and compatible third-party integrations. Data collected may include distance, pace, speed, time, elevation, route, heart rate, cadence, and calories burned. The Platform may offer rankings, leaderboards, and challenges, subject to your privacy settings.

Meal Plans and Calorie Tracking: The Platform provides personalised meal suggestions and alternatives based on your dietary preferences and goals. Users can log and monitor daily calorie intake for meals, snacks, and beverages.

Smart Hydration Reminders: The Platform may provide hydration reminders based on user-provided information, activity data, environmental factors, and other available inputs.

Limitations: Internet access is required to use the Platform. The Services are for wellness guidance only, are not medical services, and are not a substitute for professional medical advice, diagnosis, or treatment. Activity tracking data are estimates and may be affected by device limitations, GPS inaccuracies, signal interference, or user input errors; TURÓ does not guarantee their accuracy or reliability.

Users can avail Premium Services by subscribing to periodical plans (monthly or annual) through the Platform. Specific details about pricing and features will be clearly communicated before you subscribe. Certain advanced features, such as historical data retention, advanced comparisons, and export of activity data, may be restricted to specific tiers.

Payment is processed via Apple In-App Purchases. By providing your payment information, you authorise TURÓ to charge the applicable subscription fees. Subscriptions automatically renew unless cancelled prior to the end of the ongoing billing period.

TURÓ may offer trial periods at its discretion.

By enabling location-based features, you expressly (i) consent to the collection, use, and processing of your geolocation data for the limited purpose of providing personalised suggestions and related services, in accordance with our Privacy Policy; and (ii) accept the safety, security, and other risks associated with using TURÓ or third-party geolocation features, including when recording or sharing GPS-based activities.

The accuracy of location-based features depends on your device's GPS and other location services, and TURÓ is not responsible for inaccuracies arising from your device. You may disable location access at any time through device settings; however, this may restrict certain features of the Platform. You agree to use geolocation features in a way that is safe, secure, and responsible.

The Platform supports integration with devices such as Apple Watch and Fitbit to provide personalised recommendations based on your actual activity levels and health metrics.

Through device integration, the Platform can track steps, sleep cycle, heart rate, and calorie intake. The frequency and scope of synchronisation depends on your device's technical capabilities, connectivity, and the permissions you grant. TURÓ makes no warranty regarding uninterrupted or complete synchronisation across all devices and operating system versions, and cannot guarantee absolute data accuracy.

Health device integration is optional; disabling it may affect TURÓ's ability to provide certain services and recommendations.

The Platform uses APIs including Mapbox (for coordinates and map requests) and Apple HealthKit (for syncing health, activity, and local notification data). TURÓ may integrate with other third-party services to enhance functionality; your use of such services may be governed by their own separate terms and privacy policies.

TURÓ does not own, operate, or control third-party services and assumes no responsibility for their content, availability, data handling practices, or security standards. No payment method data (credit/debit card details, net banking details, etc.) is collected, processed, or stored by TURÓ directly.

Functionality dependent on third-party APIs may be limited or unavailable if the third-party service experiences downtime, changes its API, or terminates its relationship with TURÓ.

All subscriptions display the final payable price in euros (€), inclusive of applicable taxes. TURÓ reserves the right to revise pricing at any time; changes affecting future renewals will be communicated in advance, and continued use after a price change constitutes acceptance of the revised pricing.

Payments are processed via secure Apple In-App Purchases. All payment timelines and settlement processes are indicative and may be subject to banking or gateway constraints.

Subscriptions are billed monthly or annually and auto-renew at the end of each billing cycle unless cancelled beforehand. If a scheduled payment fails, TURÓ may retry the transaction; continued failure may result in suspension or termination of the subscription. If you believe you have been charged in error, notify TURÓ within 7 days of the billing date.

Subscriptions may be cancelled at any time through your account settings. Cancellation takes effect at the end of the current billing period. Subscription fees for the current period are non-refundable once payment has been processed; no pro-rated credits will be issued for unused portions, except where required by applicable law or platform rules.

TURÓ reserves the right to cancel subscriptions in cases of suspected fraud, violation of these Terms, or circumstances that compromise service quality or safety. Refunds in such cases are determined case-by-case. Nothing in this section affects any statutory withdrawal or consumer rights that may apply under applicable law.

If you are a consumer residing in the European Economic Area, you may have the right to withdraw from your subscription within fourteen (14) calendar days from the date it is concluded, without giving any reason. To exercise this right, notify TURÓ of your decision via an unequivocal statement to the contact details in these Terms before the withdrawal period expires.

If you validly withdraw, TURÓ will reimburse all payments received in connection with the subscription without undue delay, and in any event no later than fourteen (14) calendar days from the date TURÓ is informed of your decision, using the same payment method as the original transaction.

If you expressly request that Services begin during the withdrawal period and acknowledge you will lose your right of withdrawal once the digital content or services are fully provided, that right may be lost or limited as permitted by law. This right does not apply where you are acting for purposes relating to your trade, business, craft, or profession. Where a subscription is purchased via Apple In-App Purchases, refunds and withdrawal requests may also be subject to Apple's own policies.

TURÓ may from time to time offer first-time user discounts, referral incentives, seasonal promotions, or other marketing offers. Each promotion is governed by its own specific terms including eligibility criteria, validity period, redemption method, and usage limitations.

Unless expressly stated otherwise, promotions cannot be combined with other offers and cannot be applied retroactively. TURÓ reserves the right to modify or discontinue any promotion at any time and to suspend or disqualify users found misusing a promotion.

You agree to use the Platform in compliance with all applicable laws and these Terms, and are solely responsible for any content you submit, post, or display. TURÓ does not endorse or guarantee any such content, and you accept all risks relating to your reliance on it.

You must not, among other things:

• Attempt to gain unauthorised access to any portion of the Platform or connected systems
• Use automated means (bots, scrapers, spiders, scripts, crawlers) to access or collect data
• Transmit viruses, worms, malware, or other malicious code
• Engage in harassment or harmful behaviour toward other Users
• Create or share false or misleading information, or send unsolicited communications
• Impersonate any person or entity
• Use the Platform for any illegal purpose or in violation of applicable law
• Attempt to decipher, decompile, or reverse engineer any part of the Platform
• Interfere with or disrupt the integrity or performance of the Platform
• Share or transmit content that is illegal, obscene, defamatory, hateful, or infringes another's rights

You are responsible for ensuring that exercise routines, dietary content, and other recommendations are suitable for your health condition, and for the accuracy of information you provide about your fitness level and health status. Consult a healthcare professional before using the Platform if you have any health concerns.

All content on the Platform ("Company Content") is the property of TURÓ and is protected by international copyright, trademark, and other intellectual property laws. The TURÓ name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of TURÓ or its affiliates.

TURÓ grants you a limited, personal, revocable, non-transferable, non-sublicensable, and non-exclusive licence to access and use the Services, and may withdraw this licence at any time without needing to give reasons. Your use of the Platform does not grant you any intellectual property rights in the Company Content.

By posting content to the Platform, you grant TURÓ a worldwide, non-exclusive, royalty-free, irrevocable, and fully licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media, for as long as necessary to operate, improve, and promote the Platform. This licence ends when your content is deleted from TURÓ's systems. You represent that you own or control the rights to content you post and that it does not infringe any third party's rights.

As part of providing the Services, TURÓ may use and develop artificial intelligence (AI) and machine learning to provide features designed to enhance your training and improve the Services. AI technologies have known and unknown risks and limitations and may make mistakes; AI-generated recommendations may not always be accurate, complete, or suitable for your circumstances.

You understand and agree that you use AI Features at your own risk and should always use common sense and good judgment before acting on any AI-generated recommendation, to ensure it is safe, secure, and appropriate for your skill level.

TURÓ's Privacy Policy forms an integral part of these Terms and governs the collection, use, processing, storage, and disclosure of personal data in connection with your use of the Platform. By agreeing to these Terms, you acknowledge and agree to be bound by the Privacy Policy, as may be amended from time to time.

The Platform is currently available in Spain. TURÓ reserves the right to limit or restrict access from certain locations or to certain Users at its discretion, and the availability of certain features may vary by location due to legal or licensing requirements.

The Platform and these Terms are available in Spanish and English. In case of any discrepancy between language versions, the Spanish version shall prevail.

As TURÓ expands to other regions, additional terms or modifications may be implemented to comply with local laws and regulations.

Occasionally the Platform may contain typographical errors, inaccuracies, or omissions relating to descriptions, promotions, offers, and availability. TURÓ reserves the right to correct any such errors and to change or update information at any time without prior notice, and undertakes no obligation to do so except as required by law.

The Platform's Services may occasionally be interrupted for scheduled maintenance, upgrades, emergency repairs, or due to telecommunications failures beyond TURÓ's control, which may result in loss of certain content, features, or functionality.

You agree to defend, indemnify, and hold harmless TURÓ, its affiliates, subsidiaries, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or fees (including reasonable attorneys' fees) arising out of or relating to: your violation of these Terms or applicable law; your use of the Platform and its content; your athletic activities generating content you post; your violation of a third party's rights; any breach of your representations and warranties; and any harmful act toward another User.

If TURÓ is subject to a claim for which it is entitled to indemnification, you must cooperate in its defence. TURÓ may, at your expense, assume exclusive defence and control of any such matter, and you may not settle any such claim without TURÓ's prior written consent.

The Platform and all Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. TURÓ disclaims all warranties including merchantability, fitness for a particular purpose, title, and non-infringement, and does not guarantee that the Platform will be uninterrupted, timely, secure, or error-free.

Your use of the Services and any athletic activities resulting from that use, including following a training plan or recommendation, are at your own risk. You will be solely responsible for any injury, damage, or loss resulting therefrom. Information shared via the Services is for educational and entertainment purposes only, is not medical or professional advice, and should never replace the advice of a physician or other qualified healthcare provider.

To the maximum extent permitted by applicable law, in no event will TURÓ be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.

TURÓ shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay is caused by a Force Majeure Event — including acts of God, natural disasters, pandemics, war, terrorism, government action, or industry-wide strikes, among other listed events beyond TURÓ's reasonable control.

TURÓ will make reasonable efforts to notify Users of any Force Majeure Event affecting the Platform and will resume performance of its obligations as soon as reasonably possible once the cause is removed.

You may stop using the Platform at any time; this will not automatically terminate your User Account, and no refunds or pro-rated credits will be issued for unused subscription periods. TURÓ reserves the right to suspend or terminate your access at any time, without notice, if it believes you have violated these Terms or engaged in suspected illegal, fraudulent, or abusive activity.

Termination of your User Account may include removal of access to all Services, deletion of associated files and content, and barring from further use of the Platform, including re-registration under a new account.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability. TURÓ may retain your information after termination for as long as permissible for backup, archival, audit, or legal purposes.

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by the courts of Barcelona, without prejudice to any mandatory consumer protection rights and jurisdiction rules that may apply.

TURÓ reserves the right to amend, update, or modify these Terms at any time at its sole discretion. Updated Terms will be released on the Platform and will effectively substitute the original Terms; you may visit the Platform at any time to review the latest version.

If you do not agree to the new Terms, you may stop using the Platform. Continuing to use the Platform after the new Terms take effect means you are bound by the modified Terms.

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, that provision shall be eliminated or limited to the minimum extent necessary so that the remaining provisions of the Terms continue in full force and effect.

These Terms, together with the Privacy Policy, any agreement expressly incorporated herein, and any other terms notified to you or updated from time to time, constitute a legally binding agreement (the "Agreement") between you and TURÓ.

TURÓ's failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.

TURÓ has the right, in its sole discretion, to transfer or assign all or any part of its rights under these Terms, and to delegate or use third-party contractors to fulfil its duties and obligations in connection with the Services.

You may not assign or transfer these Terms, by operation of law or otherwise, without TURÓ's prior written consent. Any attempt to do so without such consent will be null and of no effect.

Visiting the Platform, sending emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that they be in writing.

You agree to the use of electronic signatures, contracts, orders, and other records, and waive any rights or requirements under applicable law that would require an original signature or delivery or retention of non-electronic records. A printed version of these Terms and any electronic notice will be admissible in judicial or administrative proceedings to the same extent as documents originally generated and maintained in printed form.

TURÓ is an open and inclusive platform built to help everyone. Any discrimination against a User based on gender, race, age, religious affiliation, sexual preference, or otherwise is not acceptable and may result in the suspension or removal of that User's account.

Nothing in these Terms, including registration on the Platform, constitutes an agency agreement or creates a principal-agent relationship between you and TURÓ, or makes TURÓ a participant in a joint undertaking. The relationship is solely one of independent contractors.

The Services are a place to connect Users virtually to share experiences and information safely. TURÓ is a neutral party to interactions between Users and is not responsible for those interactions or any information shared between them, and has no obligation to confirm the identity or qualifications of any User. You must always use common sense and good judgment when dealing with other Users.

Section titles and headings in these Terms are for convenience only and have no legal or contractual effect. Any rights not expressly granted in these Terms are reserved.
